Father:

1. A male person whose sperm unites with an egg, resulting in the conception of a child.
2. A man who adopts a child.
3. A man who raises a child.

Note that regardless of whether an individuals penis was involved the act of raising a child and acting in a “parental” capacity bestows fatherhood. Within a marriage any offspring is automatically considered to be the child of the husband regardless of actual paternity.

My mother told me the story of a woman in their town who had an affair while her husband was off in the war. She became pregnant as a result. When he returned there was no drama and he loved and raised the child as his own. His explanation was that everyone was in crisis and if his wife needed comfort she had a right to it. And because this child issued from the woman he loved it was every bit as much his child. If only such a sensible man could be cloned.

Turning from that to the exact opposite. A post at thescottross wherein he bemoans a man having to continue to make child support payments for what as it turns out are not his biological children. He titles the post this way;

both are incorrect.

They are not someone else’s kids. He parented them and had a relationship with them he was the only father the now teens have ever known. They are in fact, in deed, and in law his children.

The G&M is also wrong. He did father the children. The only thing he didn’t do is donate the sperm.

Certainly marital infidelity (something far more men engage in) is a serious blow to a relationship, however for this man to turn his back on these girls who did nothing to him is beyond shameful. For others to back him in his abuse of these children is contemptible.

and this bit of drivel is beyond the pale, one only hopes the young women in question do not ever see such putrid scrawlings;

This is just one more in a string of rulings over the past ten years that ensure children receive child support, regardless of the circumstances. While I disagree with the ruling, it’s important to remember the courts look at these issues with priority on “the best interests of the child” as well as the status quo: in short, while what mom did was probably despicable, the status quo is that this man has been paying support for a number of years so to have him suddenly stop paying support would upset the status quo thereby having a negative impact on the best interests of the children. Very simply: courts in Canada RARELY upset the status quo regardless of whether it is child support or custody and access… the status-quo is presumed to be in the best interest of the children and that’s that.

My advice to young men: wrap it up. Wrap it up twice. Don’t shack up with a woman who has kids from a previous relationship because if you act in the place of a parent, you’re liable for child support. Don’t enter into a commonlaw relationship and have kids… ever. You will have no rights as a father. Finally, if you want to get married, do not marry her if she refuses to sign a prenuptial agreement… it’s just not worth the risk.

the Judge’s words

The judge noted that Mr. Cornelio wondered at the time of his separation whether a man named Tony with whom his wife had had an affair might be the father of the children.

“It was not until access was interrupted and Ms. Cornelio commenced proceedings seeking increased child support that the respondent began pursuing this issue,” the judge remarked.

In any event, she said that it would be wrong for the children to suffer for events over which they had no control.

“Mr. Cornelio was the only father the twins knew during the course of the marriage,” Judge van Rensburg said. “The relationship that developed from the time of their birth was the natural relationship between a parent and his children.

“The fact of that relationship – even if it has now become strained – is sufficient to require Mr. Cornelio to continue to contribute toward the children’s material needs.”

Child support, Judge van Rensburg said, is the right of a child even if a parent behaves poorly, “whether it be delay in pursuing support, an attempt to contract out of support, or the failure to disclose an extramarital affair that may have led to the conception of the child.”

Lying Liars still Lying or How I Sold My Foetus On Ebay
2008 saw an attempt in Colorado to have eggs legally regarded as persons. This was rightly defeated. An attempt to make abortion illegal under essentially any condition including life of the mother in South Dakota. Again defeated.
And a number of bills proposed which would reopen the abortion debate in Canada, as well as make contraception and abortion more difficult to access. Bill C484, C537 And we find out there is a secret cabal plotting to take away women’s rights.

Women still to Blame
One of the rules of a journalist agreement signed in Argentina was

Too bad media didn’t take that tact when reporting on the killing spree in the so called Santa Killer case. References are consistently made to how his wife leaving him triggered his violence as if it was her fault. This is not an isolated instance in fact it is a sickeningly common occurrence.

Conservatives™ hate Democracy
Harper decided to prorogue parliament rather than face a coalition which represented 62% of the Canadian 2008 election voters. He relied heavily on many Canadians lack of knowledge of how our system works to shift that blame to the coalition members. An Angus Reid poll had this question;

A presidential system, with an executive branch that is separate from the legislature

Why I can’t imagine who *cough* Harper *cough* would want to go to an American style of government.

Fundies Discover Feminism
Sarah Palin is chosen as the running mate for McCain. Every remark made about her from her clothing expenditures to her ability to answer simple questions like what newspapers do you read, is met with a refrain of that is sexist!
An ironic twist in a campaign that featured right wing talking heads making egregiously sexist remarks re Clinton and whose GOP fan base eschews feminism like reality.

Morgentaler receives the Order of Canada.
An award highly overdue. Fundie heads explode and calls for return of other awards are made. Interestingly they didn’t see the awards as being tainted by the likes of a paedophile priest. Oh well we all have our own moral compass.

Ontario is finally doing the right thing and trying to correct some of the exploitation of workers through temp agencies.

Just a few of the highlights. There is always hope that 2009 will be better but it is unlikely.

‘Tis the Season of the Pharisees

Just like many other Canadians this holiday season my family will be ‘making do’. For us the war on Christmas is not the inclusiveness of the many celebrations that take place at this time of year. It is not a choice of Merry Christmas or Happy Holidays on a sign or Christmas card. Heck I have Christmas cards that I received as a child back in the sixties that say Happy Holidays. It is not nativity scenes being kept off public property. The real war on Christmas is declared by the corporatists and right wingers. Corporations continue to move jobs off shore while at the same time advertising tells us we are somehow lacking without the latest and greatest new thing we should go into debt for. Right wingers and their ideologue political choices continue to filter money to their corporatist friends while gutting programs that help those in need.

How many children will wonder why Santa bypassed their homes this year? How many families will recall Christmas’s with son’s, daughters, mothers, fathers, sisters, brothers, uncles , aunts, civilians and soldiers alike now dead because of war? How many families will spend Christmas wondering if the New Year will include employment or knowing it won’t? Wondering if they will even have a home next Christmas. How many are waiting for the political will to ensure there are jobs instead of rhetoric about people needing to tighten their belt or accept service positions that won’t cover the bills?

The war is on the people and it is year round. It relies on mean spirited, selfish motivations. It relies on those willing to spout a philosophy they cannot live. Those who spend the year advocating against relief programs then professing to protect the legacy of one who was born homeless and into poverty to young single mother.

Reporting with Non-Sexist Language

A group of journalists in Argentina have hashed out a ten point guideline of non-sexist reporting. Covering things like stopping referring to partner murder as “crimes of passion” to perpetuating the Madonna myth when reporting on female violent crime.

Among other evidence for sexism in news coverage, PAR mentions “detailed descriptions of what a woman was wearing or, in the case of murders committed by women, emphatic indignation because they go against ‘maternal instinct,’ which is a way of sacralising motherhood.”

“There is an exaggeration of the association between motherhood and womanhood, and an underlying need for women to be good,” the journalist said.

The document will officially launch Nov. 25th, which is also International Day for the Elimination of Violence Against Women.

The new rules;

1. The following terms are correct usage: violence against women, gender-based violence and sexist violence.

2. Gender-based violence is a crime insofar as it is illegal behaviour that must be prevented and punished, a social problem, an assault on the right to life, dignity, and physical and psychological integrity of women, and an issue that concerns the defence of human rights.

3. We will uproot from our work the term “crime of passion” to refer to murders of women who are victims of gender violence. Crimes of passion do not exist.

4. It is of the utmost importance to protect the identity of the victim, rather than that of the aggressor. Make it clear who is the aggressor and who is the victim, and indicate what attitudes and situations may put women in violent relationships at risk, to help raise their awareness about their situation.

5. Some information can harm the victims and their families. It is not always a good idea to identify the victim. It is offensive to refer to victims by diminutives, short forms of proper names, nicknames, and so on.

6. We will never look for justifications or “motives” (alcohol, drugs, arguments, jealousy, a couple’s separation, infidelity, and so on) that only distract attention from the central issue: violence. The cause of gender-based violence is the control and domination that certain men exercise over women.

7. It is essential to check the facts, especially from official sources.

8. Keep the subject on the agenda by denouncing violence in all its forms: psychological, economic, and emotional, without waiting for women to be killed. Tell the story taking into account the uniqueness of each event, but also the elements that each has in common with other cases. This will help us avoid the use of expressions like “once again” or “yet another case of,” and prevent a dulling of sensitivities.

9. Be particularly careful with the photographs and images illustrating the article. Respect the victims and their families, and avoid sexism, sensationalism and obscenity. Never steal images or audio material from a victim. When using a musical background, do not select motifs that inspire terror, or lyrics that talk about “love-sickness” or jealousy.

10. Our articles will always include a free telephone helpline number for victims, and any other information that may be useful for them.
